Multiple DUI Defense in Cherry Hill
Direct Representation for a Second or Subsequent DWI Charge
A repeat DWI arrest requires close examination of the current allegations and the conviction history that could affect sentencing. At Law Offices of Stephen Lukach III, we defend Cherry Hill clients facing second and subsequent DWI allegations, including those commonly described as multiple DUI offenses.
Attorney Stephen Lukach is a Board Certified Municipal Court Trial Attorney certified by the Supreme Court of New Jersey. He is one of only 35 attorneys in the state to hold this certification. During more than 20 years in practice, he has handled thousands of cases while focusing primarily on New Jersey DWI law.
Stephen personally handles each case from start to finish rather than assigning it to an associate or case manager. He reviews the alleged offense, prior record, available evidence, and potential sentencing exposure before developing a defense strategy based on the individual circumstances.

Second DWI Penalties Under New Jersey Law
Under N.J.S.A. 39:4-50, a second DWI violation carries a fine ranging from $500 to $1,000 and 30 days of community service. It also carries imprisonment for at least 48 consecutive hours and up to 90 days. The minimum incarceration period can’t be suspended or served on probation.
A second conviction also results in a driver’s license suspension of one to two years. After license restoration, an ignition interlock device is required for two to four years. These consequences apply to a confirmed second violation, not every later-offense case.
Repeat DWI Cases in Cherry Hill
DWI matters arising in the township are handled by Cherry Hill Municipal Court. Its jurisdiction includes cases originating with Cherry Hill Police, New Jersey State Police, and Port Authority Transit Police.
The court determines whether the state has proven the allegation and, following a conviction, what sentence applies. In a repeat-offense case, that decision requires examination of the driver’s prior DWI history. The wording of the current complaint doesn’t by itself determine whether someone is treated as a repeat offender.
